Intellectual property

The purpose of this page is to set out the intellectual property rules applicable to the website https://fohzshop.fr, published and operated by FōhzShop, as well as to the associated contents, software, programming interfaces, systems and distinctive signs.

Anyone who accesses the Site or uses an associated service is deemed to have taken note of these rules.

Unless prior written authorisation has been obtained from FōhzShop, no licence or right is granted merely by accessing the Site or consulting the contents.

All Contents of the Site are protected by intellectual property law, including copyright and trademark law.

Unless prior written authorisation has been obtained from the Holder, any reproduction, representation, modification, adaptation, distribution, extraction or exploitation, in whole or in part, of the Contents is prohibited.

The photographs, descriptions and technical documents made available on the Site are provided solely to allow consultation and purchase of the products. They confer no right of commercial reuse.

The software, source code, architectures, databases and technical elements enabling the operation of the Site and associated systems are the exclusive property of the Holder or its rights holders. They are protected by copyright.

Any unauthorised reuse may constitute infringement and give rise to civil proceedings and, where applicable, criminal proceedings.

The APIs, back offices, management tools, databases and internal systems used by FōhzShop are reserved for internal use or for third parties expressly authorised by contract.

FōhzShop reserves the right to block any suspicious access, retain useful technical evidence and take any appropriate action in the event of unlawful use.

The API infrastructure of FōhzShop, in particular on api.fohzshop.fr, may be equipped with detection, behavioural analysis and traceability mechanisms.

Attempts at scraping, unauthorised access or abusive exploitation of endpoints may be subject to technical recording, including logs, request metadata, IP addresses, user-agents and timestamps, to the extent necessary for security and the establishment of evidence.

These security processing operations fall within the framework described in the Privacy policy. Useful evidence may be retained for possible legal proceedings or liability actions.

The name FōhzShop is protected as a word mark registered with the INPI.

Registration confers an exclusive right of use on French territory. Any unauthorised use of the sign FōhzShop, or of signs creating a likelihood of confusion, for identical or similar activities may be prosecuted as infringement.

The filing and ownership of the trademark are held on behalf of BRAG, whose registered office is located at 5 impasse de la Colombette, 31000 Toulouse, France.

The trademark is registered in particular in classes 12, 25, 35, 37 and 42.

The trademarks, logos and distinctive signs of manufacturers or partners mentioned on the Site belong to their respective holders.

FōhzShop acts as a distributor or licensee where applicable, and claims no ownership rights in those signs merely by reason of their display on the Site.

Any use of those signs by the User remains subject to the rights of their respective holders.

The User may consult the Site and use the Contents strictly within the framework of browsing and purchasing the products offered.

Infringements of intellectual property may constitute copyright infringement within the meaning of Articles L. 335-2 et seq. of the French Intellectual Property Code, without prejudice to other applicable legal grounds.

The Holder reserves the right to bring any appropriate civil or criminal action, to seek cessation of the disputed acts and compensation for the damage suffered.
