Purpose

This privacy policy (hereinafter the "Policy") is intended to inform persons who use the website https://fohzshop.fr, published and operated by FōhzShop, about the collection, use, retention and sharing of their personal data.

Definitions

For the purposes of this Policy, the following terms have the meanings set out below:

Website: the website accessible at https://fohzshop.fr, together with all of its pages, subdomains and associated services.
Personal data: any information relating to an identified or identifiable natural person.
Processing: any operation or set of operations performed on Personal data, including in particular collection, recording, organisation, retention, use, disclosure or erasure.
Controller: the company BRAG, identified in the Legal notice, which determines the purposes and means of the Processing, and hereinafter referred to under the trading name FōhzShop.
User: any natural person who accesses the Website, browses, creates an Account, uses a service or places an order.
Account: the personal space that the User may create in order to access certain features of the Website.
Processor: any person who processes Personal data on behalf of the Controller.
Policy: this document, made available on the Website.

Controller

Purposes of Processing

The Controller carries out Processing of Personal data in connection with the operation of the Website and the commercial relationship.

The purposes pursued include in particular the following:

management of User Accounts and authentication
taking, payment, performance and tracking of orders
delivery, invoicing and after-sales service
management of contact requests, returns, withdrawals and after-sales tickets
commercial prospecting and marketing, where authorised
improvement of the Website, security, fraud prevention and technical diagnostics
compliance with applicable legal and regulatory obligations

The Personal data collected are limited to what is necessary having regard to these purposes.

Categories of Personal data

Depending on the services used, the Controller may collect the following categories of Personal data.

These categories include in particular:

identification data: surname, first name, email address, telephone number
location data: billing and delivery addresses
Account data: identifiers, preferences, login history
transactional data: order history, amounts, payment methods, payment status
browsing and technical data: IP address, logs, Cookies and similar technologies
support data: content of messages, tickets and attachments useful for handling the request

Card payment data are processed by the payment provider. FōhzShop does not store full bank card numbers on its own systems.

Legal bases

Each Processing operation is based on a legal basis provided for by Article 6 of the GDPR.

Depending on the case, the applicable legal bases are as follows:

performance of a contract or of pre-contractual measures, in particular for orders, delivery, the Account and customer service
legal obligation, in particular for invoicing, accounting and certain retention obligations
legitimate interest, in particular for the security of the Website, fraud prevention, improvement of the service and, where applicable, prospecting of existing customers within authorised limits
consent, in particular for certain non-essential Cookies, certain marketing operations or any Processing that requires it

Where Processing is based on consent, the User may withdraw it at any time, without affecting the lawfulness of Processing carried out before such withdrawal.

Recipients and Processors

Personal data are accessible to authorised persons of the Controller, on a need-to-know basis.

They may also be disclosed to the following categories of recipients:

technical providers for hosting, authentication, databases and storage, including Firebase (Google LLC) and Vercel
payment and fraud prevention providers, including Stripe
technical monitoring and diagnostic providers, including Sentry
advertising or campaign measurement providers, only after consent where required, including Google, Meta and OpenAI
support chat providers, including Crisp, when that service is active and, where applicable, after consent
carriers and logistics providers for the performance of deliveries
public authorities, where required by law or upon official request

Processors act on behalf of the Controller and are contractually framed, in particular under Article 28 of the GDPR, so as to ensure the confidentiality and security of Processing.

Transfers outside the European Union

Certain technical providers may be located outside the European Union or may entail a transfer of Personal data outside the European Union.

Where that is the case, the Controller ensures that appropriate safeguards are put in place within the meaning of Chapter V of the GDPR, including in particular standard contractual clauses of the European Commission, or that the transfer is based on an adequacy decision where such a decision applies.

Retention periods

Personal data are retained for a limited period that is proportionate to the purposes pursued and to the applicable legal obligations.

By way of indication, the following periods apply:

commercial management and Account data: duration of the relationship, then archiving for three (3) years from the last useful interaction
accounting records and invoices: ten (10) years, in accordance with accounting obligations
prospecting data: three (3) years from the last contact
non-essential Cookies and associated connection logs: thirteen (13) months maximum. Essential Cookies and certain local storage items (cart, preferences) may be retained until deleted by the User, as detailed in the Cookie policy
inactive Accounts: deletion or anonymisation after three (3) years of inactivity, subject to retention obligations

Upon expiry of these periods, Personal data are deleted, anonymised or archived in accordance with the applicable legal obligations.

Security

In accordance with Article 32 of the GDPR, the Controller implements appropriate technical and organisational measures to protect Personal data against destruction, loss, alteration, unauthorised disclosure or access.

These measures include in particular:

password encryption and access controls
authentication and limitation of privileges
backups and system monitoring
use of providers offering appropriate security safeguards

Despite these measures, no system is entirely free from risk. In the event of an incident likely to result in a high risk to your rights and freedoms, you will be informed under the conditions provided for by the applicable regulations.

Cookies

The Website uses Cookies and similar technologies to ensure its operation, remember certain preferences and, where applicable, measure the effectiveness of campaigns or carry out advertising after consent.

The Controller endeavours to respond within one (1) month. This period may be extended by two (2) months in the event of complexity or a high volume of requests.

If you consider that your rights are not being respected, you may lodge a complaint with the CNIL (www.cnil.fr).

Changes to the Policy

The Controller may amend this Policy at any time, in particular to take account of changes to the Website, providers or applicable regulations.

The applicable version is the one published on the Website. In the event of a substantial change, information may be provided by any useful means, including a notice on the Website or by email where appropriate.

The last update date appearing at the end of the document is authoritative as to the applicable version.
