These general terms and conditions of sale (hereinafter the "GTCS") govern the contractual relationship between the company publishing the website https://fohzshop.fr, trading under the commercial name FōhzShop, and any person making a purchase on this website.
The GTCS apply to every purchase made on the website.

Any person placing an order acknowledges having read these GTCS and accepting them without reservation before confirming their purchase. Acceptance of the GTCS entails waiver of any of their own general purchasing conditions, where applicable.

For the purposes of these GTCS, the following terms have the meanings set out below:
The Seller offers Products for sale, including electric scooters of various brands including Dualtron, Teverun, Nami, Rovoron, Odyssr, Kaabo, Langfeite and InMotion, spare parts, accessories and, where applicable, components manufactured to the Buyer's specifications or clearly customised.
Offers remain valid for as long as they are displayed on the Website, subject to available stock. If a Product becomes unavailable after an Order has been recorded, the Buyer will be informed as soon as possible.
The Seller reserves the right to modify, suspend or discontinue the sale of a Product. For any availability question, the Buyer may use our Contact us page.
The electric vehicles sold by the Seller are Personal Light Electric Vehicles (EDPM) within the meaning of Article R. 311-1 of the French Highway Code. They are delivered speed-limited to a maximum of twenty-five (25) kilometres per hour, in accordance with applicable regulations.
The Buyer undertakes to use electric vehicles in compliance with EDPM regulations, including speed limits, the prohibition on riding on pavements, the wearing of required protective equipment according to the area, the prohibition on carrying a passenger, and compliance with the Highway Code rules applicable to EDPM.
Any technical modification intended to remove or bypass speed-limiting devices is prohibited and may give rise to penalties. The Seller disclaims all liability in the event of use that does not comply with EDPM regulations.
For further information, the Buyer may consult the Electric scooter regulations (EDPM) page as well as the official resources available on service-public.fr.
Certain Products are marked as "for regulated use" and are subject to specific legal restrictions. They are prohibited from installation, modification and use on French public roads within the meaning of the Highway Code.
The purchase of these Products is intended exclusively for use on private roads, closed circuits or any area not accessible to the public. The Buyer undertakes to comply with this restriction and confirms that use will be consistent with their lawful purpose.
The Buyer assumes full civil and criminal liability for any non-compliant use. The Seller disclaims all liability regarding the use of these Products. Their purchase constitutes acceptance of these restrictions.
Subject to applicable statutory exclusions, the Consumer's right of withdrawal remains applicable to Products for regulated use, under the conditions set out in these GTCS and in the Refund policy.
Product prices are stated in euros (EUR), inclusive of all taxes (TTC), including VAT at the legal rate in force on the date of the Order. Shipping and handling charges are billed separately and are shown distinctly before final confirmation of the Order.
The Seller may change its prices at any time. Products are billed on the basis of the rates in force at the time the Order is confirmed, subject to availability. In the event of a manifest pricing error, the Seller may cancel the Order, even after confirmation, and refund any sums already paid.

Anyone may request a promotional code from the Seller. Codes granted apply, in principle, a seven (7) % discount on the Order, unless otherwise stated. Only one code may be entered per Order, at the time of payment.
The Seller may create, modify, deactivate or delete a code at any time, without compensation. No adjustment is due if the code was not entered, was no longer active or was refused.
If the Seller associates an Account with a code, the Buyer may access the Affiliation dashboard and accumulate credits on sales made with that code. These credits correspond to one per cent (1 %) of the amount actually paid, after deduction of refunds and credits. They may be used on the Website after a period of fifteen (15) days, unless the order is cancelled or refunded during that period. In the event of a refund or cancellation, credits are adjusted or withdrawn, including from any balance already available.
Affiliation credits are purely virtual. They have no monetary value outside the Website, do not constitute a claim payable in cash and may not be withdrawn, converted into money or paid by bank transfer. They serve exclusively to reduce the amount of Orders placed on the Website, up to the displayed balance.
The Seller may modify the programme rules, withdraw access, cancel an Order or deactivate a code at any time. For more information, see the Frequently asked questions.
Orders are settled on the basis of payment before Products are shipped. The Order becomes firm only after the Seller has accepted payment, subject to any useful checks.
The Buyer has, in particular, the following payment methods:
The Seller may refuse or cancel any Order in the event of a legitimate suspicion of fraud, inaccurate or inconsistent information, or conduct detrimental to its legitimate interests.
The invoice is generated upon confirmation of the Order. For a bank transfer, the Buyer receives an email containing the bank details, the exact amount and the payment instructions. The Order and the invoice remain available in the customer area.
For payment by bank transfer, the Buyer has three (3) business days from confirmation of the Order to make the transfer. If payment is not made within that period, the Order is cancelled automatically, without prior formal notice.
Other payment methods, including bank card, PayPal or Klarna, are processed through an immediate payment process.
For pre-order Products, full payment is due upon confirmation of the Order, under the same terms as for other Products.
Products are delivered in mainland France, within the European Union and internationally, according to the methods and indicative timeframes presented on the Website at the time of the Order.
The Seller selects the carrier and shipping arrangements best suited to the nature of the Products, their destination and logistical availability.
Delivery times stated on the Website are indicative. The Seller endeavours to meet them, but cannot be held liable for delay attributable to force majeure or to an external event beyond its control.
For deliveries outside the European Union, customs duties, import taxes and other regulatory charges remain payable by the Buyer.
The Buyer has Order tracking in their customer area. The Seller undertakes to notify any significant delay that may affect the planned delivery.
Unless otherwise required by law, the transfer of the risk of loss or deterioration of the Products occurs when the goods are handed over to the carrier for deliveries to a Consumer, or according to the terms indicated at the time of the Order. Where the Buyer entrusts the goods to a carrier other than the one proposed by the Seller, the transfer of risk occurs upon handover of the goods to that carrier.
New electric vehicles benefit from a commercial warranty of twenty-four (24) months from delivery, covering technical failures occurring during compliant use. Batteries are covered by a specific twelve (12) month warranty. Their gradual natural wear is not covered.
The benefit of the commercial warranty is subject to compliance with the prescribed maintenance schedule. The first service must be carried out between five hundred (500) and nine hundred (900) kilometres. Subsequent services follow usage intensity and the Seller's recommendations. Failure to comply with these obligations may result in a refusal of cover.
The following are, in particular, excluded from the commercial warranty:
After-sales service is provided by the Seller. Depending on the nature of the failure, return of the Product may be required for diagnosis and repair.
The statutory warranties of conformity and against latent defects remain applicable to the Consumer. For further information, see the Warranties & after-sales page and your After-sales tickets area.
Pursuant to Article L. 221-18 of the French Consumer Code, where the Buyer acts as a Consumer, they have a period of fourteen (14) days from physical receipt of the Products to exercise their right of withdrawal, without having to give reasons or pay any penalty.
Pursuant to Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to Products manufactured to the Buyer's specifications or clearly customised, including made-to-measure components produced at their request.
Subject to that exclusion, exercising the right of withdrawal requires return of the Products in their original condition, complete, with all their accessories and packaging. The Buyer may try the Product to the extent necessary to establish its nature, characteristics and functioning. Any use beyond that reasonable trial may result in a reduction in value or a refusal of refund. Unless otherwise required by law, return shipping costs remain payable by the Buyer.
The request may be submitted from the Right of withdrawal page or by email to retour@fohzshop.fr, stating the Order number. Detailed terms for returns, costs and refunds are set out in the Refund policy.
For pre-order Products, full payment of the price is required upon confirmation of the Order. No deposit or partial payment system is offered. Once payment has been made, the pre-order cannot be cancelled by the Buyer.
No refund is due before actual delivery of the pre-ordered Product, except in the event of definitive impossibility of delivery attributable to the Seller.
Once the Product has been delivered, the Consumer has the statutory fourteen (14) day withdrawal period. Return shipping costs remain payable by the Consumer, in accordance with the terms of the Refund policy.
Estimated delivery times are shown on the Product page when they can be determined. Otherwise, the Buyer may request an estimate via our Contact us page. These timeframes are indicative and may be extended depending on supply constraints.
The Seller informs the Buyer of any significant delay. Confirmation of the Order constitutes acceptance of these pre-order terms.
The Seller processes personal data in connection with the management of Accounts, Orders, customer service and, where applicable, prospecting, in accordance with the GDPR and the French Data Protection Act (loi Informatique et Libertés).
The Buyer has rights of access, rectification, erasure, objection, portability and restriction of processing, which may be exercised in accordance with the terms set out in the Privacy policy.
The use of Cookies and similar technologies is described in the Cookie policy.
The Seller may temporarily suspend or permanently terminate a Buyer's Account in the event of a breach of these GTCS, fraud, payment default or any conduct detrimental to its legitimate interests.
The Buyer may request deletion of their Account at any time. Such deletion results in the erasure of personal data in accordance with the Privacy policy, subject to statutory retention obligations, including accounting obligations.
The Seller shall not be liable for indirect damage, loss of business, commercial prejudice, loss of data or other consequential damage arising from use of the Website or the Products, subject to the mandatory provisions applicable to Consumers.
In the event of a technical malfunction affecting Website accessibility, the Seller endeavours to resolve it as soon as possible. It cannot be held liable solely by reason of temporary unavailability.
Nothing in these GTCS limits the mandatory rights available to the Consumer under applicable law.
All elements of the Website, including texts, images, logos, trademarks, databases and interfaces, are protected by intellectual property law.
The trademarks and distinctive signs of manufacturers mentioned on the Website belong to their respective owners. The Seller acts as a distributor and claims no ownership rights over those signs.

The Seller shall not be held liable for delay or non-performance resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code, including industrial disputes, health restrictions, natural disasters, failures of transport networks or any event beyond its control.
In the event of force majeure, the Seller informs the Buyer as soon as possible and may, depending on the circumstances, propose alternative performance arrangements or a refund of sums paid.
The Seller may amend these GTCS at any time. The version applicable to an Order is the version published on the Website at the time that Order is confirmed.
It is the Buyer's responsibility to consult the GTCS regularly. Continuing to place Orders after publication of a new version constitutes acceptance of that version for subsequent Orders, subject to mandatory legal provisions.
These GTCS are governed by French law.
In the event of a dispute, the Buyer is invited to contact the Seller first in order to seek an amicable solution, in particular at contact@fohzshop.fr.
The Consumer may also use a competent consumer mediator or the online dispute resolution mechanisms provided for by European regulations, where applicable.
Failing an amicable solution, and subject to the mandatory provisions applicable to Consumers, the competent courts shall be those of the jurisdiction of the Seller's registered office located in Toulouse.
