Terms of use

These terms of use (hereinafter the “TOU”) are intended to define the terms of access to and use of the website https://fohzshop.fr, published and operated by FōhzShop.

Any browsing on the Site, any creation of an Account, any use of an online service or any order implies full and unreserved acceptance of these TOU. If you do not accept these terms, you must stop using the Site.

The TOU apply to all users, whether acting as consumers, professionals or simple visitors.

In the event of a conflict on a point relating to a sale, the Terms of Sale prevail for that point.

The Site is freely accessible to any User with an internet connection. Costs relating to equipment, connection and hosting remain solely at the User’s expense.

FōhzShop endeavours to ensure continuous and secure access to the Site. However, access may be interrupted, suspended or limited for reasons of maintenance, update, security, force majeure or for any other cause beyond the control of FōhzShop.

FōhzShop does not guarantee that the Site will be free from errors, interruptions or incompatibilities with all browsers, operating systems or devices. The User is invited to use an up-to-date and secure technical environment.

FōhzShop reserves the right to modify, suspend or withdraw all or part of the Site’s features, temporarily or permanently, without this giving rise to any right to compensation, subject to mandatory legal provisions.

Browsing the catalogue and navigating the Site are possible without an Account. However, certain features require the creation of an Account. The User then undertakes to provide accurate, complete and up-to-date information.

The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their Account. Any fraudulent or unauthorised use must be reported without delay to FōhzShop through our Contact us page or at contact@fohzshop.fr.

FōhzShop reserves the right to refuse the opening of an Account, or to suspend or close an Account, in the event of inaccurate information, abusive use, breach of these TOU, suspected fraud or failure to comply with applicable regulations.

The User may request deletion of their Account under the terms set out in the Privacy Policy, subject to legal retention obligations and to files still being processed.

The User undertakes to use the Site fairly, in accordance with its intended purpose and respectfully of the rights of FōhzShop and of third parties. Access to the Site is reserved for legitimate personal or professional use, within the framework of the services offered.

In the event of a breach, FōhzShop may take any appropriate measure, including suspension of access, closure of the Account, removal of Contents and, where applicable, the initiation of civil or criminal proceedings.

The information present on the Site, including product descriptions, technical characteristics, photographs, availability, indicative timeframes and associated documents, is provided for information purposes and may evolve.

FōhzShop endeavours to present accurate and up-to-date information. Errors, omissions or variations related to manufacturer updates, stocks or supply constraints may nevertheless occur. The contractual information applicable to an order is that confirmed during the purchase process and in the Terms of sale.

Photographs and illustrations are non-contractual, unless otherwise stated. Performance, range, speeds and technical characteristics depend on conditions of use, maintenance and manufacturer specifications.

All Contents of the Site are protected by intellectual property law. Unless express authorisation has been obtained, any reproduction, representation, modification, adaptation, distribution or exploitation, in whole or in part, is prohibited.

The trademarks, logos, names and distinctive signs present on the Site are the property of FōhzShop or of third parties that have authorised their use. No licence or right is granted to the User merely by accessing the Site.

The Site may contain links to third-party sites or services. These links are provided for the User’s convenience. FōhzShop does not exercise permanent control over these sites and declines all liability as to their content, availability or practices.

The creation of links to the Site is authorised provided that it does not harm the image of FōhzShop, does not create confusion as to the origin of the Contents and does not involve misleading framing. FōhzShop reserves the right to request the removal of any link deemed non-compliant.

FōhzShop implements reasonable means to ensure the availability, security and quality of the Site. Its liability cannot be engaged in the event of interruption, bug, technical incompatibility, loss of data resulting from non-compliant use, or damage linked to an act of the User, of a third party or to a case of force majeure.

The User remains solely responsible for the use made of the information consulted on the Site and of the decisions taken on that basis. For matters relating to sale, delivery, warranties and refunds, the applicable liability regimes are those provided for by the Terms of sale, the Refund policy and the regulations in force.

Nothing in these TOU limits the mandatory rights available to the consumer under applicable legislation.

Use of the Site may involve the processing of personal data, in particular when creating an Account, placing an order, submitting a contact request or opening an after-sales ticket.

FōhzShop reserves the right to amend these TOU at any time, in order to adapt them to changes to the Site, to the services offered or to applicable regulations.

The applicable version is the one published on the Site on the date of consultation or use of the relevant service. In the event of a substantial amendment, FōhzShop may inform Users by any useful means, in particular by a notice on the Site or by e-mail where appropriate.

Continued use of the Site after publication of the amended TOU constitutes acceptance of the new terms, subject to mandatory legal provisions.

These TOU are governed by French law. Subject to the mandatory provisions applicable to consumers, the competent courts shall be those of the jurisdiction of the registered office of FōhzShop.

In the event of a dispute, the User is invited to contact FōhzShop beforehand in order to seek an amicable solution. The consumer may also have recourse to the competent consumer mediators or to the online dispute resolution platforms provided for by European regulations, where these are applicable.
